Our resort store is stocked with everything you need, from trail permits and official Hatfield McCoy Trail souvenirs to basic necessities, firewood, ice, and refreshments. Our deluxe RV sites feature covered parking for your trail machines, concrete parking pad, privacy fence, picnic table, built-in firepit, and charcoal grill. Rules

-While each park attempts to accommodate your exact spot request, the on-site manager has the ultimate decision for spot placement. -CHECK-IN/OUT TIME: Check-in time is 3:00 pm. Check-out time is no later than 11:00 am. -CHECK-IN PROCEDURES: You will receive a gate code via text the day before you arrive. Please contact us if you do not receive this, as cell service is limited in the area. Upon arrival, please register at the office. At this time, you will verify the number in your party. We will ask you to provide us a copy of your driver’s license and your credit card and CV number with your name and billing address. Office hours vary depending on the season. If you are not checking in until after 8:00 pm, you must notify the office before arrival. -FEES AND PREPAID DEPOSITS: Reservations require at least a 50% deposit made by credit card or check to guarantee your reservation. This deposit must be received before the campsite will be secured for your reservation. -CHARGEBACKS: Camper will not claim any chargebacks or credits from his/her credit card company for any fees charged to his/her credit card, including but not limited to deposit, rental, or additional damage, or security deposit fees. -RETURNED CHECK FEE: There is a $50.00 per check fee for all returned checks. -SPEED: Speed is limited to 10 mph on resort property. Speed limits are strictly enforced to ensure guest safety. No speeding or driving recklessly is permitted. -CAMPFIRES: Campfires are allowed only in designated areas and must be contained within the fire ring. All our campsites have fire rings, and there is firewood for sale at our office. We enforce all local burn bans. Campfires must never be left unattended. Fireplaces/rings are not to be moved. -FIREWORKS: No fireworks are allowed on the resort property. -VEHICLES & TRAILERS: Each site will accommodate 2 vehicles and 2-trailers. Please contact our staff for additional trailer storage locations. -QUIET HOURS: Between the hours of 10:00 pm to 7:00 am, noise interfering with the peaceful enjoyment by occupants of adjoining sites is strictly prohibited. Children must be on their site supervised by an appropriate adult by 10:00 pm. -Riding after dark is not permitted within the resort. -Parents must be responsible for the safety and actions of their children at all times. Vandalism will not be tolerated. -GUNS: Guns are not permitted on resort property. -ALCOHOLIC BEVERAGES: Alcoholic beverages are permitted only at guests’ reserved sites. Alcohol consumption and open containers are not permitted in the common areas of the resort. Excessive use will not be tolerated. -Underage drinking or drug use will be reported to the police, and offenders will be banned from the resort without a refund. All cabins and heliport are smoke-free buildings. -DAMAGE/ VANDALISM/THEFT: Devil’s Backbone Adventure Resort and its owners and employees are not responsible for damage, vandalism, or theft of guests’ RV or other personal possessions. -ACTS OF GOD: Guests agree to relieve Devil’s Backbone Adventure Resort and its owners and employees of any responsibility of "Acts of God". -WILDLIFE: The resort is home to black bears and other wildlife that are known to frequent the resort. For the safety of our guests: 1) absolutely no feeding of black bears or wildlife, 2) remove all food items from outside areas, 3) place any trash in the provided dumpster, and 4) properly lock all food in appropriate locations. -TRASH: DO NOT LEAVE TRASH OUT OVERNIGHT. Dumpsters are located at designated locations throughout the resort. -GRAY WATER: The dumping of gray water on the ground is against the law. Anyone caught dumping gray water on the ground will be evicted immediately, without a refund. Devil’s Backbone Adventure Resort is intended to be a friendly, family-oriented resort. We reserve the right to eject anyone who does not comply with these Rules and Regulations, which are intended to make your stay more enjoyable. ANYONE EJECTED WILL NOT RECEIVE ANY REFUND AND SHALL BE REQUIRED TO IMMEDIATELY VACATE THE SITE. -IN CONSIDERATION of being permitted to enter Devil’s Backbone Adventure Resort, I/we agree on behalf of ourselves and where applicable minors accompanying me/us that: -RELEASE OF LIABILITY: I/we agree not to sue Devil’s Backbone Adventure Resort, LLC and Red Jacket Coal Company, LLC, d/b/a Red Jacket Coal Operations, LLC, their respective officers, members, managers, owners, employees, affiliates, agents, assigns, and parents (collectively “Devil’s Backbone”). I/we agree to waive and release to the maximum extent allowed by law, Devil’s Backbone from any and all claims and causes of action of every kind arising from any and all physical injuries, including death, emotional injuries, and/or damages that may happen to me/us, whether known or unknown, arising out of or in any way connected with my/our presence or activity on the property owned or operated by Devil’s Backbone Adventure Resort (the “Premises”). I/we release Devil’s Backbone from all liability its/their own negligence. -ASSUMPTION OF RISK: I/we acknowledge that use of the Premises is AT MY/OUR OWN RISK. I/we understand there are inherent risks involved in any activity on the Premises. Inherent risks include but are not limited to negligence or intentional acts of others in or on the Premises, the operation of autos, trucks, recreational vehicles, off-road vehicles, or any other motorized vehicle and activities related thereto can constitute a dangerous activity, and voluntarily assume all risk of any damage, injury, or loss which may occur to me/us during the course of my activities related thereto. Inherent risks also include the failure of Devil’s Backbone to warn me/us of a specific inherent risk. I/we agree to ASSUME ALL INHERENT RISKS, known and unknown, in any way connected with my participation in any and all recreational activities on the Premises, including but not limited to the risks of serious personal injuries, death, illnesses, and/or loss of personal property. I/we assume all risks caused by the negligence of Devil’s Backbone. -INDEMNITY: I/we agree to DEFEND, INDEMNIFY AND HOLD HARMLESS Devil’s Backbone, to the maximum extent allowed by law, from any expenses, attorney's fees, loss, liability, damage, or cost they may incur arising out of any claim or cause of action for any injuries, wrongful death, losses, or damages of any kind that have been released or discharged by this Release. That by indemnifying Devil’s Backbone, should it be necessary for Devil’s Backbone, to incur attorney’s fees and costs to enforce this agreement or any portion thereof, I/we voluntarily agree to pay Devils Backbone, reasonable costs and attorney’s fees arising therefrom. I/we intend and agree to defend, indemnify, and hold harmless Devil’s Backbone from any and all liability for their own negligence. -DURATION OF AGREEMENT: I/we agree that this agreement shall be effective from the date signed and SHALL CONTINUE FOR ALL FUTURE VISITS TO THE PREMISES of Devil’s Backbone. I/we release my/our right to sue Devil’s Backbone in relation to any incidents related to any future visits to the Premises. -RULES: I/we agree to comply with all rules, terms, and conditions for participation in any and all activities. I/we acknowledge that I/we have had available to me a copy of the rules and regulations of Devil’s Backbone Adventure Resort and posted throughout the Premises. If I/we observe any unusual hazard during my presence or participation, I/we will remove myself from participation and immediately bring such danger to the attention of an employee of Devil’s Backbone Adventure Resort. No dangerous or inappropriate conduct will be tolerated. Offenders will be required to leave, and no refunds will be given. All participants agree to strictly comply with the rules, and the attendant on duty has sole discretion to determine compliance. -ENTIRE AGREEMENT: I/we agree that this contract contains the entire agreement between the parties and supersedes any prior discussions or agreements, written or oral. I/we intend this release to be as broad and inclusive as permitted by law. If any provision of this agreement is found unenforceable or invalid, the provision shall be severed from the contract and the remainder shall remain in full force and effect and shall be enforceable to the fullest extent of the law. -GOVERNING LAW: I/we intend and agree that this agreement shall be governed by West Virginia law, and shall be binding upon my/our heirs, agents, descendants, dependents, executors, administrators, assigns, successors and representatives. Any claim or lawsuit brought to enforce the terms of this agreement shall be brought exclusively in the Circuit Court of Mingo County, West Virginia. If any dispute whatsoever should arise between the parties, I/WE WAIVE THE RIGHT TO A JURY TRIAL. No pets are permitted in Cabins, Deluxe Tents, or RV Rentals. PETS: Only one dog per site is allowed. Pets must be on a short leash at all times and shall remain tied on a strong durable chain or rope that will not allow the pet to extend off a site in any direction. Pets must never be left unattended. 1. Dogs are only permitted in the heliport and at RV sites. Any damage due to pets may be subject to additional fees. 2. The pet shall always be on a short leash. Children shall not be allowed to walk pets. All pet/dog droppings shall be the responsibility of the pet owner. 2. All pets should have proper papers for vaccinations, which must be presented at registration. West Virginia law requires proof of rabies vaccination. 3. If any pet is creating a disturbance or being a nuisance, the pet shall immediately be removed at the request of the Manager. 4. No pets are allowed in the restrooms, with the exception of service dogs. 5. Dogs must not be left unattended. 6. Visitors may not bring pets to the resort.

Cancellation Policy

MODERATE If the guest cancels at least 1 week before your check-in day and time, they will receive a full refund (minus Spot2Nite convenience or resort fees). If the guest cancels within the 1 week before check-in, there will be no refund.
